NOTICE REGARDING NRS 281.551(4)
NRS 281.551(4) was added to the Nevada Revised Statutes in 1997, and set forth civil penalties to be assessed for violations of NRS 294A.345 and NRS 294A.346. On March 29, 2005, U.S. District Court Judge Lloyd George entered an order which enjoined the Nevada Commission on Ethics from enforcing the provisions of the Nevada Revised Statutes which provide for the filing of campaign practices complaints (NRS 294A.345 and NRS 294A.346). Further, AB 499 of the 2005 Nevada Legislature repeals NRS 294A.345, NRS 294A.346, and NRS 281.551(4) effective October 1, 2005. Therefore, the Commission is not able to accept complaints regarding campaign practices, and no further opinions will be issued under NRS 281.551(4).

applicable to opinions issued
prior to June 11, 2003 under the 2003 Nevada Revised Statutes
Prior to June 11, 2003, NRS 281.551(2)(a) allowed the Commission to impose a civil penalty against persons who submitted to the Commission an accusation or information that was false in bad faith or with a vexatious purpose. On September 19, 2001, U.S. District Court Judge David Hagen ruled this statue violated the First and Fourteenth Amendments to the U.S. Constitution and entered an order which enjoined the Nevada Commission on Ethics from enforcing the provisions of NRS 281.551(2)(a). Further, SB 147 (Chapter 501) of the 2003 Nevada Legislature repealed NRS 281.551(2)(a) effective June 11, 2003. Therefore, no further opinions will be issued under NRS 281.551(2)(a).
